This is the Mobile Application Privacy Policy (“Privacy Policy”) of Skedaddle, Inc. (“Skedaddle” or “us” or “we”). This Privacy Policy explains how we collect, use and store the information we obtain from or about you when you use our services (the “Service”) through our mobile application (the “App”). This privacy policy is not a contract and does not create any legal rights or obligations. By using the Service or the Apps, you accept the Privacy Policy and you expressly consent to our collection, storage, use and disclosure of your information as described in this Privacy Policy. INFORMATION WE COLLECT


Through the App we collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as your IP address, device ID, anonymous usage data, general demographic information we may collect, preferences you submit and preferences that are generated based on the data you submit. Personal Information includes information that can be linked to a specific individual, such as a name, address, telephone number, payment information, email address, login information for third party sites and other information which you submit to us through the App.


Information you provide us when setting up a profile or using the App


When you use the App, you will be asked to provide us with personally identifiable information, including your email address, phone number, name, date of birth, payment information (including zip code) and login information for third party sites (e.g. Facebook) (a “Social Network Site”).


If you login to the Service using your account information for a Social Network Site, we access and collect information about your use of the Social Network Site and information you provide to such Social Network Site. To the extent you and the Social Network Site allow, we may access all of your information that is publicly available to other users of the Social Network Site and all information you have provided to the Social Network Site, such as login e-mail and other contact information, network statistics and updates regarding your Social Network Site account. You consent to such access and our collection, storage and use of this information in accordance with this Privacy Policy.


Information collected from your Device or Technology


Location Information


If you have provided permission through your device, Skedaddle may obtain pinpointed physical location information from technologies like GPS, Wi-Fi, or cell tower proximity. You are able to withdraw your permission for Skedaddle to acquire pinpointed location information from your device through your device settings. The App can use the geo-location features (GPS or network-based) to support your use of location-based tools.


Information Collected Automatically


The App may access certain device information and/or components automatically. This access is only for purposes of providing the Service to you within the App.


Push Notifications


A push notification token will be used to send push notifications to your mobile device with updates regarding your Routes. If you choose, the App can also open your default e-mail program to enable to you send e-mails to Skedaddle.


Our Policies Concerning Children


You need to be 18 years of age in order to create a Route or book a ticket on a Route using the Service. Skedaddle does not knowingly collect or use personally identifiable information from children under 13. If a child under 13 has provided us with personally identifiable information without parental or guardian consent, the parent or guardian should contact us at the email address provided below and we will remove the information and unsubscribe the child from any promotional opportunities. In the event that a Route is booked for a child under the age of 18 on such child’s behalf, the person providing any personally identifiable information about such child must be such child’s parent or legal guardian.


HOW WE USE AND SHARE INFORMATION


Personal Information


Personal Information you provide to us is used to help us communicate with you and to provide you with the Service. For example, we use Personal Information to contact users in connection with the provision of the Service to users, in response to questions, to solicit feedback from users, to provide technical support, and to inform users about promotional offers. We share your full name with Charter Operators (as defined in our Terms of Use: www.letskedaddle.com/terms_of_use), who use that information to confirm your identity when you arrive at the passenger pick-up location at the departure time for your Route. We also share your full name with other confirmed participants on your Private Route. We may also provide your information to third parties for the processing of that information solely for our benefit, but we will not provide your information to any third party for marketing purposes.


All payments and credit card transactions are processed by our third party payment processor, Stripe, and not by Skedaddle. Any credit card and billing address information that you provide through the Service is collected by Stripe and is governed by such Stripe’s separate privacy policy, available at https://stripe.com/privacy. Please consult Stripe’s privacy policy. You will be subject to Stripe’s privacy policies to the extent that you provide your information to Stripe in order to conduct transactions through the Service. Skedaddle does not control and is not responsible for the privacy policies of Stripe or other third parties.


We do not sell Personal Information collected through the App to any third parties, except as may arise in connection with a sale of all or part of our assets, a bankruptcy, or business combination, in which event our subscriber database including Personal and Non-Personal Information would be expected to be transferred to the parties to such transactions.


Non-Personal Information


We use Non-Personal Information to help us improve the Service and customize the user experience. We also may aggregate Non-Personal Information in order to track trends and analyze use patterns on the App. Periodically, we might share aggregated information on usage behavior such as booking patterns, preferences on Routes for market research or other purposes and will not contain any Personal Information of any individual. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.


Mergers, Acquisitions and Similar Business Transactions


In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information as well as Non-Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy.


Sharing Information with the Government or As Otherwise Required by Law


Skedaddle cooperates with government and law enforcement officials to enforce and comply with the law. We may therefore disclose your information as listed above, if we have a good faith belief that it is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce our Terms of Use or a Charter Operator’s terms, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Skedaddle, its users or the public as required or permitted by law.


Data Retention


The App will store user-provided data for as long as you use the App, unless you choose to delete it or ask us to delete it. Only information provided for Route purchases and related activities will be stored in our operational systems as needed to provide your requested services.


SECURITY


We implement security measures designed to protect your information from unauthorized access, disclosure or accidental loss or destruction of Non-Personal Information and Personal Information. We have established appropriate physical, technical and managerial safeguards designed to protect the information we collect from or about our users. These safeguards are regularly reviewed to protect against unauthorized access, disclosure and improper use of your information, and to maintain the accuracy and integrity of that data.


OPT-OUT RIGHTS; TRACKING PREFERENCES


You may opt-out of all information collection by uninstalling the Apps. You may opt-out of receiving push notifications in your preferences registered on the Apps. You may use the standard uninstall, application and data management processes available as part of your mobile device or via the removal features provided in the applicable mobile app store. Once you have uninstalled the App, all information that it stored is deleted, including any preferences you previously set around location permissions and whether you have allowed Skedaddle to send you push notifications. Once the App is uninstalled and preferences are deleted, the push notifications stop.


You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional email communication to a user, the user can opt-out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out in the Settings section of the App, we may continue to send you administrative emails including, for example, in order to effectively provide you with the Service and periodic updates to our Privacy Policy.


We do not use information gathered within the App to serve you targeted advertisements. The “limit ad tracking” or similar advertising-related privacy settings offered by device manufacturers do not change how your device is tracked by Skedaddle.


CHANGES TO OUR PRIVACY POLICY


Skedaddle may occasionally update this Privacy Policy. When we do update this Privacy Policy, we will also revise the “Last Updated” date at the top and bottom of the Privacy Policy. If we make changes to the Privacy Policy that, in our discretion, we consider significant, we will post the updated Privacy Policy on the App and we may also send e-mails to our users who have created a Skedaddle account containing a link to the revised Privacy Policy. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. Please review this Privacy Policy periodically to stay informed about how Skedaddle is protecting the personally identifiable information we collect. If you continue to use the Service or the App after we post an update to this Privacy Policy, you indicate your acceptance of the updated Privacy Policy.


USERS OUTSIDE THE UNITED STATES


Skedaddle is a corporation organized under the laws of Delaware. The servers upon which the App and Service are hosted are located in the United States. Users who access or use the Service from other jurisdictions do so at their own choice and risk and are solely responsible for compliance with local law. Please note that the personal information you submit using the Service may be transferred to and stored in the United States to be processed by us so we can provide the Service to you as set forth in this Privacy Policy and the Terms of Use. If you are not a resident of the United States, you acknowledge and agree that we may collect and use your personal information outside your home jurisdiction, and that we may store your personal information in the United States. Please note that the level of legal protection provided in the United States or other countries in which you may access the App or use the Service may not be as stringent as that under certain privacy standards or the privacy laws of some other countries, possibly including your home jurisdiction.

The Website does not currently recognize browser “do not track” signals.
